Terms of Service - Harbour Studios

Welcome to Harbour Studios Limited! By accessing or using our services, you agree to be bound by the following terms and conditions ("Terms of Service"). Please read them carefully.

1. General Terms:

1.1 These Terms govern your use of all services provided by Harbour Studios Limited ("we," "us," "our"), including real estate photography, videography, drone services, and any other related services.

1.2 By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Services:

2.1 Photography Services: Harbour Studios Limited provides property media services, including but not limited to traditional property photography, videography, drone photography, 360-degree photography, floor plans, and more.

2.2 Service Scope: The scope of each project, including pricing, deliverables, and deadlines, will be clearly outlined and agreed upon between the client and Harbour Studios Limited prior to commencement. Any changes or additional requests may result in additional fees.

2.3 Client Responsibilities: Clients must ensure that the property is prepared for photography before our arrival, including cleaning, staging, and organizing as necessary. Harbour Studios Limited is not responsible for any property condition issues that may affect the final product.

3. Payment and Fees:

3.1 Pricing: Our prices are subject to change and will be communicated prior to the commencement of each project. All payments must be made in accordance with the terms outlined in the project agreement or invoice.

3.2 Payment Terms: Payment is due upon completion of the service, unless otherwise agreed in writing. We currently accept bank transfer and cash.

3.3 Late Payments: Failure to pay within the specified time frame may result in the withholding of deliverables until payment is received.

3.4 Pricing Structure & GST: All prices displayed on our website and provided in quotes are exclusive of GST (Goods and Services Tax) unless explicitly stated otherwise. GST will be added to the final invoice total where applicable.

4. Deliverables:

4.1 Delivery: Final images and videos will be delivered within the agreed timeframe, typically 1-2 business days after the photography session.

4.2 Usage Rights: Clients are granted to use the photos/media however they wish and can be uploaded to Trade Me, the clients listing site, or any MLS service, etc. No consent is necessary before uploading/using our photos/media.

4.3 Edits and Revisions: Clients may request a reasonable number of edits or revisions within 3 days of receiving the final deliverables. Any additional revisions may be subject to extra charges.

5. Cancellations and Rescheduling:

5.1 Cancellations: If a client needs to cancel a scheduled session, they must provide at least 3 hours of notice. Cancellations made after this period may incur a fee.

5.2 Rescheduling: Clients may reschedule sessions without penalty if sufficient notice is provided, as outlined in Section 5.1. We reserve the right to reschedule sessions due to unforeseen circumstances, such as adverse weather conditions for drone photography.

6. Liability:

6.1 Limited Liability: Harbour Studios will not be held liable for any damages, losses, or injuries arising from the use of our services, including but not limited to any issues related to property condition, unforeseen weather conditions, or any other factors beyond our control.

6.2 Client Property: While we take reasonable care during photography sessions, we are not responsible for any damage to client property, unless caused by our negligence.

7. Privacy:

7.1 Data Collection: We may collect personal information from clients in order to provide our services. This information is handled in accordance with our Privacy Policy.

7.2 Third-Party Sharing: We do not share client information with third parties unless required by law or with the client's explicit consent.

8. Copyright and Intellectual Property:

8.1 Copyright Ownership: Harbour Studios retains ownership of all photos, videos, and other media produced unless otherwise agreed upon in writing.

8.2 Usage Rights for Harbour Studios: We reserve the right to use any images or videos for marketing and promotional purposes, including but not limited to our website, social media, and portfolios, unless the client specifically requests otherwise in writing.

9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.

10. Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on our website, and your continued use of our services after such changes will constitute your acceptance of the new Terms.
